JUDGMENT

(Judgment of the Court was delivered by C.V.Karthikeyan, J.) The learned counsel for the appellant and the first respondent are present. Exercising much prudence, the parties had entered into initially a Joint Memorandum of Compromise which was entered under the aegis of the Madras High Court Mediation and Conciliation Centre on 31.10.2025. Subsequently, they had also entered into an Addendum in November 2025 which is only an extension of the earlier Joint Memorandum of Compromise. 2.Both the Joint Memorandum of Compromise and the Addendum are recorded and should be part of the Judgment. The Appeal stands dismissed as settled out of Court.

3.In view of the fact that the Appeal has been dismissed as settled out of Court, the appellant is entitled for refund of the Court fees in accordance with the Rules. Consequently, connected miscellaneous petition is also closed. No costs.
