PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the first respondent to withdraw the Look Out Circular bearing No.2022427309 issued against the petitioner by the first respondent in respect of Crime No.458 of 2022 pending on the file of the third respondent.

O R D E R

This Writ Petition has been filed to issue a Writ of Mandamus, to direct the first respondent to withdraw the Look Out Circular bearing No.2022427309 issued against the petitioner by the first respondent in respect of Crime No.458 of 2022 pending on the file of the third respondent.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 and 2 and perused the materials available on record.

3. It is submitted by the learned Additional Public Prosecutor that the investigation has been completed and charge sheet has also been filed before the learned Judicial Magistrate No.I, Chengalpat and the same was taken on file in C.C.No.667 of 2023 and the matter is posted for framing of charges on 09.01.2025. He further submitted that if the look out circular is withdrawn, the petitioner/accused may move away from the jurisdiction of the court. Hence he prayed for dismissal of the above criminal original petition.

4. Admittedly, the petitioner is the first accused in Crime No.458 of 2022. The respondent police after completion of investigation, filed the charge sheet on the file of the Judicial Magistrate No.I, Chengalpat and the learned Magistrate has also taken the charge sheet on file in C.C.No.667 of 2023. Now the case is posted for framing of charges on 09.01.2025.

5. Under the abovesaid facts and circumstances, this Court is not

inclined to allow this writ petition. However, the learned Magistrate is directed to frame the charges on the abovesaid date without fail and summon the witnesses and complete the trial and dispose the case in C.C.No.667 of 2023 in accordance with law within a period of three months.

6. With the abovesaid direction, the Writ Petition is dismissed. No costs.
