This Criminal Original Petition is filed not to harass the petitioners under the guise of enquiry based on the summons issued by the 2nd respondent.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that the 3rd respondent is the husband of the 1st petitioner who has given a complaint about the matrimonial dispute and wilful withdrawal from the consortium. Hence the petitioners were called for enquiry.

The learned counsel appearing for the petitioners state that already the 1st petitioner has initiated proceedings under the Domestic Violence Act for protection and therefore, the respondent police need not frequently call her and disturb.

Considering the nature of the dispute and the complaint, the respondent police is directed to summon the petitioners herein as per law, enquire the matter and proceed. Without causing summons, the petitioners shall not be disturbed to attend the enquiry. 5.
With this observation, this Criminal Original Petition is disposed of.
