[Order of the Court was made by S.S. SUNDAR, J.] These petitions are filed to condone the delay of 143 days in filing a petition to set aside the abatement caused due to the death of the sole appellant, namely Mr.M.C.Jayasingh, in O.S.A.No.231 of 2014; to set aside the abatement; and to bring on record the petitioners 1 to 6 herein as appellants in the above appeal.
2.Learned counsel appearing for the petitioners submitted that one of the daughters of the deceased sole appellant has not joined with the petitioners and therefore, she has been shown as 5th respondent in this petition.
3.This Court is convinced with the reasons for the delay stated in the affidavit filed in support of these petitions. Further, learned counsel appearing for the respondents have no objection in allowing these petitions. When the relationship between the parties and the facts stated in the affidavit are not disputed, this Court finds no impediment to allow these petitions.
