ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.681 of 1995 for an alleged offence under Section 392, 394 & 396 of IPC as against the 1st accused and Section 394 read with 34 of IPC as against the accused Nos.2 to 4. The occurrence is said to have taken place on 27.05.1995. The offences are serious in nature. At the relevant point of time, property was recovered and handed over to the defacto complainant The case is pending from the year 1999. Subsequently the defacto complainant could not be traceable. The accused persons are also elusive. Already paper publication was effected. In view thereof, under Article 226 of the Constitution of India and Section 482 of Cr.P.C., treating this case as an extraordinary case, it shall be closed for the present. However, liberty is granted to the prosecution to reopen the case, if any of the accused resurfaces in connection with another case.

3. Accordingly, the proceedings in PRC.No.200008/1999 on the file of the Judicial Magistrate No.1 Court, Arakkonam Taluk, Ranipet, is closed and this Suo Motu Transfer Case is disposed of.

19.09.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
