Ms.J.R.Archana, G.A(Crl.Side) ADVANCE ORDER The Criminal Appeal is partly allowed and the conviction and sentence imposed on the appellant/accused, viz, Dhayalan, S/o.Singaram by the learned Sessions Judge, Mahila Court, Chengalpet, in SC (K).No.18 of 2011 by judgment dated 10.05.2023 for the offences under Sections 366, 376 r/w. 511,
341 & 307 IPC are hereby set aside and in the alternative, the accused is found guilty for the offence under Sections 323 and 341 IPC and convicted and sentenced to undergo 1 year simple imprisonment for the offence under Section 323 IPC, and 3 months simple imprisonment for the offence under Section 341 IPC and the sentences shall run concurrently.
2. Since the appellant/accused has already undergone incarceration for a period of 6 years 9 months and 23 days, the maximum sentence for the offence under Sections 323 & 341 IPC being one year, the appellant/accused is directed to be set at liberty forthwith, unless his presence is required in connection with any other case.
