PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, to direct the 1st respondent herein to give police protection for Arumbavur FP39 Inland Fishermen cooperative society to catch fish in Arumbavur Big Lake, Arumbavur Village, Veppanthattai Taluk, Perambalur district and sell them without any issues in accordance with the permission granted to us vide the letter no. Tha.2/ Ko.53 (2020)/ 2020 /dated 10.12.2020 and Letter No. /Ko.48/ 2022/ Fishing/ AEE(P) dated 8.11.2022 on behalf of the public works department and water resources department by considering the representation dated 15.12.2022.

The Writ Petition has been filed to directing the 1st respondent herein to give police protection for Arumbavur FP39, Inland Fishermen cooperative society, to catch fish in Arumbavur Big Lake, Arumbavur Village, Veppanthattai Taluk, Perambalur district and sell them without any issues in accordance with the permission granted to us vide the letter no. Tha.2/ Ko.53 (2020)/ 2020 /dated 10.12.2020 and Letter No. /Ko.48/ 2022/ Fishing/ AEE(P) dated 8.11.2022 on behalf of the public works department and water resources department by considering the representation dated 15.12.2022.
2.The learned counsel appearing for the petitioner submitted that Arumbavur FP39, Inland Fishermen Cooperative Society, was granted permission to take lease of Arumbavur Big Lake, Arumbavur Village, Veppanthattai Taluk, Perambalur District for rearing fish and harvesting. This permission was granted from 2020-2021, 2021-2022, 2022-2023, 20232024 and 2024-2025. When the petitioner Society was fishing last year,
there was a objection from local village people. Therefore, the present writ petition has been filed seeking police protection. 3.The learned Government Advocate (Crl.side) appearing for the respondents submitted that based on the representation, CSR.No.22/2023 is pending.
4. I have considered the submission of the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondents.
5. It is seen from the proceedings of the Executive Engineer, Public Works Department/Water Resources Department, Marudaiyaru Basin Sub Division, Perambalur, dated 10.12.2020 that the petitioner Society was given permission from 2020-2021, 2021-2022, 2022-2023, 2023-2024 to 20242025 for rearing the fish in the above said lake with certain conditions. Therefore, this Court directs the respondent Police to consider the petitioners representation and pass appropriate orders including providing of police protection.
6. With the above direction, this Writ Petition is disposed of. No costs.
