ORDER

This writ petition has been filed to direct the 1st respondent to survey the lands of the petitioners in Survey 435/2A measuring about 50 cents situated at Pillankuppam Village, Krishnagiri Taluk and District.

2. Mrs.S.Indhu Bala, learned Additional Government Pleader, takes notice on behalf of the 1st & 2nd respondents.

3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

4. The learned counsel for the petitioner would submit that, on an earlier occasion, the petitioner made an application for surveying the subject property. However, when the surveyor made an attempt to conduct the survey, he was unable to do so, due to the objections made 2/6

by the adjacent land owners. Therefore, now, the petitioner sought for resurveying of the subject property vide appeal dated 04.04.2025. However, the same was not considered by the respondent till date. Hence, this petition.

5. In reply, the learned Additional Government Pleader appearing for the respondent would submit that the survey was already conducted at the subject property and hence, she prays for dismissal of this petition.

6. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondent and also perused the materials available on record.

7. In the case on hand, initially, on 18.01.2025, the petitioner made an application for surveying the subject property. According to the petitioner, when the surveyor made an attempt to conduct the survey, he was unable to do so, due to the objections made by the adjacent land owners. Therefore, now, the petitioner sought for re-surveying of the 3/6

subject property vide appeal dated 04.04.2025. However, the same was not considered by the respondent till date.

8. In view of the above, this Court directs the 1st respondent to dispose of the petitioner's appeal dated 04.04.2025 by surveying the subject property and fixing boundaries therein, within a period of 4 weeks from the date of receipt of a copy of this order.

Upon considering the aspect of earlier objection made by the adjacent land owners, this Court feels that it would be appropriate to provide police protection at the time of conducting survey in the subject property. Therefore, this Court suo-motto implead "The Inspector of Police, Guruparapalli Police Station, Krishnagiri District" as 3rd respondent in this petition.

10. Mr.L.Baskaran, learned Government Advocate, takes notice on behalf of the suo motto impleaded 3rd respondent. If there is any obstruction in the process of surveying and fixing boundary stones at the 4/6

subject land, the respondents 1 & 2 are at liberty to approach 3rd respondent, who shall provide all necessary assistance to them till the completion of process.

11. With the above directions, this writ petition is disposed of. No cost.
