(Order of the court was made by R.Mahadevan, J.) This miscellaneous petition has been filed by the petitioners/appellants seeking to condone the delay of 544 days in filing the above writ appeal.
2. Heard the learned Additional Government Pleader appearing for the petitioners and perused the affidavit filed in support of this petition, wherein, it has been stated that though the copy of the impugned order dated 18.04.2022 passed in W.P.No.17594 of 2022 was received by their office on 31.05.2022, the instructing authority viz., the Chief Educational Officer/Nodal Officer was wholly occupied in conducting practical examinations for X, XI and XII, public examination allocation work and paper valuation camp. Hence, there was a delay of 544 days in filing the appeal, which is neither wilful nor wanton and therefore, the delay may be condoned.
3. Having regard to the reasons stated by the petitioners, which appears to be bona fide, considering the huge delay in filing the writ appeal, we are inclined to condone the delay subject to payment of costs of Rs.1,000/- by the petitioner to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, within two weeks from the date of receipt of copy of this order. https://www.mhc.tn.gov.in/judis
