ORDER

A.No.4394 of 2025 is filed to implead the Applicant, who is a third party as a proposed defendant in O.A.No.184 of 2025 in C.S.(Comm.Div) No.58 of 2025.

2.Heard the learned counsel for the applicant and the learned counsel for the 1 st respondent (plaintiff) and the learned counsel for the 2 nd respondent.

3.Though technical objection is raised by the plaintiff, learned senior 2/4

counsel for the 1 st respondent/plaintiff submits that the applicant has been impleaded in the main Suit.

4.On careful consideration of the submissions made by the learned counsel on either sides, this Court finds that when the applicant was impleaded in the main suit, the question of filing a separate application or memo to implead him in the original application does not arise and hence even though the 1 st respondent/plaintiff raised the technical objection, the A.No.4394 of 2025 has to be allowed.

5.Accordingly, A.No.4394 of 2025 is allowed and the Applicant shall be impleaded as a party defendant in O.A.No.184 of 2025 in C.S.(Comm.Div) No.58 of 2025. The plaintiff shall carry out the amendments in the Application on or before 14.09.2025 and serve a copy of the amended Application on the other parties.

6.By consent of both the parties, post the main suit and other application on 15.09.2025.
