This Writ Petition has been filed seeking for issuance of a Writ of Mandamus, directing respondents 1 and 2 to withdraw/recall the Look Out Circular No.LOCV:71/DCA/CAMP/2023 issued against the petitioner in connection with C.C.No.2947 of 2023 on the file of the IX Metropolitan Magistrate, Saidapet, Chennai and consequently direct the 3rd respondent to permit the petitioner to travel abroad.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents 1 and 2 and perused the materials available on record.

It is seen that based on the complaint given by the petitioner's wife, the first respondent/Police registered the case against the petitioner, and since, there was non co-operation of the petitioner, the said Look Out notice was issued and he was arrested and taken into custody. On completion of the investigation, the first respondent-Police filed the charge sheet before the learned IX Metropolitan Magistrate, Saidapet, Chennai in C.C.No.2947 of 2023 and the case is pending in the stage of trial. Even without mentioning the date of Look Out notice, the petitioner has come up with the present petition seeking to direct the first respondent to withdraw Look out notice, which is nothing but frivolous one and as the look out notice has also not been produced, and on this ground alone, this Court is not inclined to entertain this petition. Hence, this Writ Petition stands dismissed. There shall be no order as to costs.
