O R D E R

This contempt petition has been filed for the alleged disobedience of the orders of this Court dated 31.03.2021 made in W.P.No.46360 of 2006.

2. Today when this contempt petition is taken up for hearing, after notice the learned Standing Counsel for the respondent Neyveli Lignite Corporation on instructions would submit that, pursuant to the orders of this Court, in compliance of the same, posting orders ie., re-posting orders in the executive cadre has been given and the petitioner has also joined duty on 03.08.2022. Therefore, the orders of this Court since has been complied with, there is no scope for filing any contempt petition and this contempt petition is liable to be closed, he contended.

3. However, Mr.B.Gopalakrishnan learned counsel for the petitioner would submit that this Court by order dated 31.03.2021 directed to give the petitioner the posting order as per the order of appointment originally issued to the petitioner in 2006 itself, but only the benefits would accrue on the petitioner from the date of joining and not from the date of 21.05.2006. However, for the said period everything should be calculated notionally and if the same is notionally calculated, she would have earned seniority, based on which she would 2 / 4

have been placed at a much higher pedestal and that is the grievance of the petitioner.

4. If that is the grievance of the petitioner, that has to be agitated very well by giving a representation to the respondents, and it is for them to consider the same on merits and for the aforesaid purpose the contempt petition cannot be persuaded further.
