PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 1st respondent to delete the petitioner's name from the history sheet rowdy list in H.S.No.475 of 2007 pending on the file of the 2nd respondent, based on his representation dated 24.10.2010 within the time. O R D E R

This petition has been filed to direct the 1st respondent to delete the petitioner's name from the history sheet rowdy list in H.S.No.475 of 2007 pending on the file of the 2nd respondent, based on his representation dated 24.10.2010 within the time. 2.Learned counsel for the petitioner submitted that the petitioner is a Secretary at the Ammaperavai Party, Kurinjipadi Town, doing contract work in Government Cable TV Connection supplies in his area and running a two wheeler stand in the Kurinjipadi area. The 2nd respondent has falsely added the petitioner as an accused in Crime No. 536 of 2003 and Crime No. 266 of 2005. Based on the same, the respondent police opened a history sheet against the petitioner in H.S.No.475 of 2007 and the same is being kept pending till date. Therefore, the petitioner has made a representation to the respondent on 24.10.2019 to remove the name of the petitioner from the history sheet.

3.This Court has carefully considered the submissions made on either side and also the materials available on record. 4.Taking into consideration the facts and circumstances of the case, there shall be a direction to the 2nd respondent police to consider the representation dated 24.10.2019 made by the petitioner to remove the name of the petitioner from the history sheet and deal with the same in accordance with the guidelines given by this Court in the case of Sabari @ Sabarigiri Vs. Assistant Commissioner of Police, Annanagar (L and O) Range, Madurai City, Madurai and others reported in (2018) 4 MLJ (Crl.)

585. This process shall be completed by the 2nd respondent police within a period of six weeks from the date of receipt of a copy of this order.

6.This Criminal Original Petition is disposed of with the above direction.
