ORDER

The petitioners, who were arrested and remanded to judicial custody on 01.08.2025 for the alleged offence under Sections 296(b), 127(2), 115(2), 140(3), 309(4), 351(2) of BNS Act, on the file of respondent police, seeks bail.

2. The case of the prosecution is that, the petitioners herein were arrested on 01.08.2025 in connection with a case of chain snatching and robbery, wherein they allegedly snatched a gold chain weighing 10 sovereigns, took a sum of Rs.15,000/- from the pocket of the victim and Rs.20,000/- from the dash board of a car at knife point along with the petitioners, two other were also involved in the commission of the crime.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that the petitioner has been suffering incarceration from 01.08.2025.

He also submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioners had snatched 10 sovereigns of gold chain, robbed Rs.15,000/- from the pocket of the victim and Rs.20,000/- from the dash board of the car. He further submitted that while attempting to abscond, the petitioners had also demanded a ransom of Rs.5,00,000/- out of which only Rs.80,000/- has been recovered so far. The investigation is also at preliminary stage. Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking note to the gravity of offence, and submissions made by both counsels, the investigation is at initial stage, and the property is also not yet recovered and there is no change in circumstances, this court is not inclined to grant bail to the petitioner.
