ORDER

The petitioner, who was arrested and remanded to judicial custody on 23.07.2025 for the alleged offences under Sections 194(3) of BNS Act @ 108, 49, 85 of BNS Act, in Crime No.201 of 2025, on the file of respondent police, seeks bail.

2. The case of the prosecution is that due to a matrimonial dispute, the petitioner and other accused persons allegedly demanded dowry and harassed the deceased, which ultimately drove her to committed suicide by hanging herself. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and has no role in the alleged dowry harassment that led to her death. He further submitted that the petitioner has been suffering incarceration from 23.07.2025. Hence, he prays for the grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the RDO report reveals that there is sufficient material to justify the arrest, and that some of the accused are absconding. It was further submitted that the case is still under investigation. Hence, he vehemently opposed the grant of bail to the petitioner.

5. Considering the gravity of the offence, and the investigation is still under investigation. If the petitioner is released on bail, he may abscond, tamper with the evidence, and hamper the witnesses. Therefore, this Court is not inclined to grant bail to the petitioner.
