Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the second respondent to give police protection to the petitioner and his family members regarding his life and property as per the representation dated 06.11.2019.

O R D E R

This petition has been filed by the petitioner to direct the second respondent to give police protection to the petitioner and his family members regarding his life and property as per the representation dated 06.11.2019.

2. The learned counsel for the petitioner has submitted that the petitioner has leased out the shop to the third respondent, he paid rent. He further submitted that some unknown persons threatened the petitioner by asking that the third respondent had borrowed money from them and with regard to https://hcservices.ecourts.gov.in/hcservices/

the same, the petitioner had lodged a complaint on 10.08.2018 before the second respondent, but, so far, no action taken and hence, he requests to provide police protection for him.

3. Per contra, the learned Additional Public Prosecutor has submitted that the dispute between the landlord and the tenant and hence, the petitioner has approached the Civil Court and get appropriate relief.

4. It is seen from the typed set of papers filed by the petitioner that on 10.08.2018, the petitioner had lodged a complaint before the second respondent stating that some unknown persons threatened the petitioner.

5. The second respondent is directed to expedite the enquiry. If enquiry reveals any cognizable offence, he has to register the case and proceed further in accordance with law. If the petitioner feels that the third respondent is giving any such problem, it is open to him to file Civil suit or RCOP for taking possession and thereafter, if necessary, he can approach the concerned forum and get appropriate order for police protection.

6. With the above directions, this petition is disposed of.
