ORDER

The petitioner has filed the present Writ Petition seeking to issue a Writ of Mandamus to direct the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.01.2018 to 02.11.2018, in paying the amounts paid towards his terminal benefits, namely EPF Employee's Contribution, Gratuity and Encashment of Leave, within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits.

2. The petitioner was appointed/working as Conductor in the respondentCorporation from 03.05.1987. After completion of 30 years of service and finally working as Special Grade Conductor with Staff No.87CR1013089 in the respondent-Corporation, he retired from service on 31.12.2017 on reaching the age of superannuation. But only after passing of several months, he has been paid the terminal benefits, without interest for the delayed payment of the same. Hence, the petitioner is forced to approach this Court praying direction to the respondent to pay the interest amounts.

3. Heard both sides and perused the materials available on record.

4. Taking into consideration the facts and circumstances of the case, a direction is issued to the respondent to determine the eligible benefits payable to 2 / 4

the petitioner and after determining that particular amount, to pay the same to the petitioner together with interest @ 6% per annum from the date on which the petitioner had retired from service, till the date of actual disbursement of the amounts.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
