ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.06.2025 for the alleged offences under Sections 194 of BNSS 2023 (under Section 174 of Cr.P.C.) subsequently altered into Sections 333, 103(1), 238, 61(2)(a) of BNS, 2023, (under Sections 452, 302, 201, 120(B) of IPC), in connection with, Crime No.20 of 2025, on the file of respondent police, seeks bail.

2. The case of the prosecution is that the petitioner conspired with the other accused and instigated them to commit the murder of her husband. The said accused persons are alleged to have murdered the deceases by strangulating him and brutally assaulting him with stones and bricks. Hence, the case.

3. The learned counsel for the petitioner submitted that, based on the confession, the petitioner has been falsely implicated in this case. He further

submitted that the petitioner has been suffering incarceration from 30.06.2025. Hence, he prays for the grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) raised an objection, stating that there are a total of seven accused, and the petitioner has been arrayed as A4. It was alleged that A1, Vennila, the wife of the deceased, was having an illicit affair with A2. She, along with A2, pre-planned and committed the murder of the deceased with the assistance of the other accused persons, including A2's friends. On the date of the occurrence, A1, A2, and the other accused conspired together and murdered the deceased. The learned Government Advocate further submitted that the case is still under investigation and that one of the accused has not yet been secured. Hence, he vehemently opposed the grant of bail to the petitioner.

5. Considering the gravity of the offence, and the investigation is still under investigation. If the petitioner is released on bail, he may abscond, tamper with the evidence, and hamper the witnesses. Therefore, this Court is not

inclined to grant bail to the petitioner.
