notification issued by the 3rd respondent vide notification dated 01/2021 dated 09.09.2021 taking into consideration of the fact that the provisional selection list in respect of other language was already published by the TRB on 27.08.2022 and consequentially to consider the petitioner for appointment to the post of P.G. Assistant (Mathematics) within the time that may be stipulated by this Court.

ORDER

With the consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

2. The petitioner claims that the provisional selection list in respect of Kannada medium pursuant to the Notification issued by the third respondent dated 09.09.2021, has not been published till date and therefore, seeks for a mandamus for such publication.

Today, when the matter was called, the learned Standing Counsel appearing for the third respondent/Board, on written instructions, submitted that the provisional selection list was already published by them on 13.10.2022. According to the learned Standing Counsel, the petitioner who belongs to BC category, had secured 92.151888 marks as against the cut off marks of 98.205459 in the concerned subject under BC category.

4. In view of the selection list already being published and also by taking into account that the petitioner does not come into the zone of consideration, the prayer sought for in the present Writ Petition does not require interference.

5. Accordingly, the Writ Petition stands dismissed. No costs. Connected miscellaneous petition is closed.
