C.M.P.No.22073 of 2025 in S.A.No.494 of 2019 K.RAJASEKAR, J., This petition has been filed by the appellant seeking to implead the Administrative General and Official Trustee of Tamil Nadu (AG and OT) as a respondent in the above Second Appeal, on the ground that the original respondent who contested the suit has passed away and has left behind no legal heirs.

2. Heard the learned counsel for the petitioner and also perused the records.

3. On perusal of the records, it reveals that the first respondent herein had earlier submitted that he was married to one G.Susila. The learned counsel has also produced the death certificate of the said G.Susila dated 29.10.2011, wherein, it has been recorded that she too has passed away on 17.10.2021.

4. Since the appellant has established that the contested respondent died without any legal heirs, this petition is allowed, and the Administrative General and Official Trustee of Tamil Nadu (AG & OT) is ordered to be impleaded as the proposed respondent in the Second Appeal.
