ORDER
This Writ Petition has been filed to direct the 1st and 2nd Respondents to forthwith de-freeze petitioner's saving account in A/c No.53210000180836 and Current account in A/c No.911020041722247 and to consequently permit petitioner to operate the petitioner's bank accounts.
2. Heard the learned counsel appearing for the petitioner, the learned counsel for the respondents 1 and 2, the learned Government Advocate (Crl.Side) appearing for the 3rd respondent and the learned Central
Government Standing Counsel appearing for the 5th respondent and perused the documents placed on record.
3. Admittedly, the petitioner and his wife are holding a Savings Account no.53210000180836 with the 1st respondent bank. Further, there is also a current account no.911020041722247 with the 2nd respondent bank under the name, SPS Builders Pvt., Ltd., In pursuant to the request made by the 5th respondent, the 1st respondent has frozen the savings account of the petitioner, which is lying with the 1st respondent. However, without any reasons, the 2nd respondent has also frozen the current account of the company of the petitioner and did not permit the petitioner to operate his savings account as well as current account.

On a perusal of the entire documents, it reveals that a sum of Rs.3,58,000/- is said to have been transferred to the petitioner's account from one M/s Marshal Agro Company and the same is lying with the 1st respondent, therefore, the 5th respondent requested the 1st respondent to mark lien of the cheated amount to the tune of Rs.3,58,000/-. Now, in the 1st respondentBank, the petitioner is maintaining the amount more than the amount of Rs.3,58,000/-

In view of the above, the 1st respondent is directed to de-freeze the savings account of the petitioner and his wife in Account no.53210000180836 with the 1st respondent bank and permit the petitioner to operate the said account, on condition to hold a sum of Rs.3,58,000/-. Further, the 2nd respondent is directed to de-freeze the current account no. 911020041722247 of petitioner's company and the petitioner is permitted to operate the said accounts forthwith.
With the above said direction, the present petition is disposed of. No costs.
