JUDGMENT

Heard both sides.

2. It is noticed that earlier the Petitioner has obtained leave to file this Appeal and such a leave was granted by this Court pursuant to which this Appeal was numbered.

3. Learned counsel for the Petitioner submits that recently the Hon'ble Supreme Court has rendered its decision in M/s.Celestium Financial Vs.A.Gnanasekaran, etc., on 08.04.2025 wherein, it has been observed that under similar circumstances, the unsuccessful complainant can approach the District Court by way of an Appeal under Section 372 of Cr.P.C., (413 of Bharatiya Nagarik Suraksha Sanhita, 2023).

4. Recording the request, leave is granted to the Petitioner to file an Appeal before the concerned District Court.

5. Needless to state that the said Appeal shall be filed by the Petitioner within a period of 30 days from today in which case, the Jurisdictional District Court shall entertain the Appeal on merits without reference to limitation.
