Prayer: Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing the respondents to include one year training period for calculating gratuity and pay the difference in Gratuity with 10 percentage interest to the petitioners. For Petitioners :

ORDER

The Writ Petition is filed for the following relief: "directing the respondents to include one year training period for calculating gratuity and pay the difference in Gratuity with 10 percentage interest to the petitioners".

2. Mrs. S.Pavithra, learned Standing Counsel (TNSTC) takes notice 2/6

for the Respondents.

3. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

4. The petitioners joined as a Trainee in the respondent Corporation. The 1st petitioner retired from the service on 30.09.2013 and the 2nd petitioner retired from the service on 30.04.2015. It is the grievance of the petitioners that the respondents while settling the Gratuity amount, has not included the period of one year training undergone by the petitioners. Hence, this Writ Petition.

Mrs. S.Pavithra, learned Standing Counsel (TNSTC) appearing for the Respondents would submit that the eligible amount would be paid to the petitioner within a reasonable time that may be fixed by this Court. 6.The learned counsel for the petitioner would submit that in all connected matters, this Court has consistently allowed the payment with interest at the rate of 6% per annum.

7. In that view of the matter, the Writ Petition stands disposed of on 3/6

the following terms:

i. The respondents shall include the one year training period for calculating Gratuity and pay the difference in gratuity amount to the petitioners, if they are eligible as per Rules, within a period of eight

(8) weeks from the date of receipt of a copy of this order with interest at the rate of 6% per annum from the date on which the amounts became due, till the date of disbursement.

ii. If the amount is not paid within a period of eight (8) weeks, thereafter, the same shall carry the interest at the rate of 12% per annum from the date on which the amounts became due, till the date of disbursement.

No costs.
