3. Recording the submission made by the learned counsel for the appellant, this Civil Miscellaneous Petition is dismissed as infructuous. Consequently, connected miscellaneous petition is closed. No costs. Since the present appeal is not admitted, Registry is directed to return the court fee to the appellant.
