Respondents Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, , directing the respondents forbearing in any manner interfering with the affairs of the petitioner's club viz., 'BLUE STAR CULTURAL ASSOCIATION'' (Regn.Sl.No.260/2006) situated at Blue Star Cultural Association located at Nos.5&7, Ranga Park, 200 Feet Inner Ring Road, Korattur, Chennai - 600 077 or its members including facilities provided for playing various games including the game of playing rummy not involving any element of gambling and to give necessary instruction to the officer's attached to Korattur Police Station, as per the dictate terms of High Court and also direct the respondent Police to De-seal the club premises for violation and illegal, unlawful and arbitrary and is not supported any statutory provision and to consider the representation sent by the petitioner to all the respondents mentioned above dated 15th April 2025. The petitioner seeks for issuance of a Writ of Mandamus forbearing the respondents from interfering with activities of the petitioner / Club, viz., 'BLUE STAR CULTURAL ASSOCIATION'' (Regn.Sl.No.260/2006) situated at Blue Star Cultural Association located at Nos.5&7, Ranga Park, 200 Feet Inner Ring Road, Korattur, Chennai - 600 077, by considering the representation of the petitioner, dated 15.04.2025. 2.The petitioner seeks an omni-bus direction not to interfere with affairs of the petitioner/Club. According to the petitioner/Club, their Association/Club is being run in a legal manner, however, the respondentsPolice have been harassing and interfering with the activities of the petitioner/Club unnecessarily and also locked the Club.
3. The learned Government Advocate (Crl.Side) appearing for the respondents, on instructions, submitted that already three F.I.R's have been registered against the petitioner/Club for the alleged gambling. One of the employees of the said Club has also committed suicide. Therefore, omni-bus direction cannot be given.
4. It is relevant to note that when there is an evidence of gambling, Police have every right to enter into the premises of the petitioner/Club. Pg.Nos.3/6
Admittedly, in the present case, three F.I.R.'s have already been registered against the petitioner/Club.
5. In such view of the matter, as long as any illegal activities are carried out, there cannot be any omnibus direction from this Court. Let the petitioner/Club/Association shall not carry out any illegal activities and they shall fix CCTV cameras in all the required places in the Club and to ensure the transparency in their Club activities. Immediately after fixing the cameras, it is open to the respondents-Police to de-seal the petitioner Club, if any such illegal activities are not carried out.
6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions is closed.
