ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.05.2025 for the alleged offence under Section Girl Missing @ 5(1) r/w 6 of POCSO Act 2012 & 87 of BNS Act, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that, the petitioner kidnapped the victim girl and committed penetrative sexual assault to the victim girl. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. He further submits that the petitioner has been suffering incarceration from 27.05.2025. He also submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner kidnapped the victim girl and committed penetrative sexual assault to the victim girl. He further submitted that now the victim girl is three months pregnant and the petitioner is a married

man. He also submitted that the investigation is not completed and awaiting for 164 statement. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the gravity of offence committed by the petitioner, and the investigation is at initial stage, this court is not inclined to grant bail to the petitioner.
