ORDER

This Writ Petition has been filed seeking a direction to the second and third respondent to allot the housing units at NVN Nagar, Thirumangalam, Chennai-40 to the petitioners.

2. Heard the learned counsels appearing on either side.

The learned counsel for the petitioners submitted that the petitioners herein had applied for housing allotment at Thirumangalam NVN Nagar Project through online CM portal on 15.07.2021, 13.12.2021 and 10.03.2022 respectively. He further submitted that the petitioners sent reminders in this regard and also personally visited the office of the respondents 3 and 4 and during the year 2022, the Revenue Inspector came for physical verification and

obtained an affidavit and thereafter, there was no response. He contended that the third respondent has sent an intimation to the petitioners 3 to 5 about allotment of housing units at Manali Pudunagar project as there were no availability of housing units at Thirumangalam. He further contended that despite there is availability of housing units at Thirumangalam, the petitioners have been neglected for allotment at Thirumangalam and hence, the present Writ Petition.

In response to the query raised by this Court on the earlier occasion in regard to availability of housing units at Thirumangalam, the learned counsel for the respondents 3 & 4 produced the letter of the fourth respondent dated 03.03.2026 and submitted that there was no availability of housing units at Thirumangalam and the housing units are available only at Manali Pudunagar in respect of Phase II & III to the amount of Rs.10,37,000/- and Phase IV to VI to the tune of Rs.6,84,000/- and if the petitioners are willing to occupy, allotment will be made to them.

5. In reply, the learned counsel for the petitioners submitted that the petitioners are not willing for allotment of housing units at Manali Pudunagar Project.
