ORDER
This Criminal Original Petition has been filed to call for the entire records pertaining to the case in Crime No. 161 of 2024 on the file of the first respondent-Police and to quash the same as against the petitioner.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first respondent-Police and perused the materials available on record.

The contents of the complaint given by Sunthai upon which the complaint registered indicates that A1 was introduced to the defacto complainant during the month of September 2020 by one Krishnaprathish, the second named accused. Based on their inducement and one Soundarapandian joined together and made an investment Rs.40,00,000/- in the on-line business assuring they will get 3% return. However, he was not paid any profit from the business as per the clause they promised to repay Rs.50,00,000/- during the year 2024.

4. Based on the complaint given by the defacto complainant, the first respondent-Police registered a case in Crime No.161 of 2024 for the offences under Sections 406, 420 and 506(1) of IPC as against the petitioner herein and others. The petitioner is arrayed as A4.
5. As far as A1, this Court vide order dated 09.08.2024 in Crl.O.P.No.13616 of 2025 had observed that neither in the complaint nor in the documents produced by the defacto complainant, there is no material to infer breach of trust or cheating and quashed the F.I.R in Crime No.161 of 2024.
6. In such view of the matter, this Criminal Original Petition is allowed. The case against the petitioner in Crime No. 161 of 2024 on the file of the first respondent-Police stand quashed. Consequently, connected miscellaneous petition is closed.
