Earlier, this Court by an order dated 10.12.2020 allowed the above petition on payment of cost of Rs.2,500/- to the respondent within a period of three weeks.

2. Today, when the matter taken up for hearing, the learned counsel for petitioner submitted that he has tendered the cost of Rs.2500/- on 10.12.2020 itself within time, however, instead of filing cost memo, he filed affidavit of service (SR.No.20441/2020), and it has been wrongly dismissed and sent to E.R. Section. Hence, the matter is listed today.

3. The learned counsel for respondent also acceded the payment, which was received by him on 10.12.2020 itself within time.

4. On recording the submissions made by both learned counsel for petitioner and respondent, this Civil Miscellaneous Petition is allowed.
