ORDER

This Criminal Original Petition has been filed to direct the respondent police to file final report in Crime No.5 of 2024 pending on the file of the respondent police, within a time as may be fixed by this Court.

The case of the petitioner is that some accused persons had forged a settlement document in respect of petitioner's property settling the same in their favour and also registered the same in the Sub Registrar Office, Chengalput. On coming to know about the same, the petitioner had lodged a complaint before the District Registrar, Chengalput who after enquiry, cancelled the forged settlement document No.822 of 2008 and subsequently, based on the complaint given by the Joint Registrar, Chengalput, the FIR in Crime No.5 of 2024 was registered on 06.01.2024 for the offences under Sections 120B, 465, 467, 471 and 420 of IPC. However, till date, no statement was received from the petitioner who is the owner of the subject property. 2/5

2. The learned Additional Public Prosecutor appearing for the respondent police submitted that since the offence is regarding forged documents, they are collecting the documents and trying to complete the investigation.

It is seen from the records and also from the submissions of the learned counsel for the petitioner that even after a period of 10 months from the date of complaint, the petitioner who is the owner of the subject property, has not been examined and no statement has been recorded from him. Hence, there is a reasonable doubt that the respondent police has not yet started the investigation.

Therefore, the respondent police is directed to complete the investigation and file charge sheet within a period of three months from the date of receipt of a copy of this order failing to file the charge sheet within the stipulated time, the Superintendent of Police, Chengalpattu, is directed to take action against the concerned Investigating Officer of the respondent police station and file action taken report before this Court. 3/5

5. With the above directions, this Criminal Original Petition is disposed of.
