The petitioner seeks anticipatory bail in Crime No.20 of 2023 registered by the respondent police for the offences punishable under Sections 417, 376(2)(n), 313, 294(b), 506(1) of IPC.

2. It is stated that when the defacto complainant when she was studying 12th standard, had a relationship with the petitioner. Thereafter, it is also stated that on 05.11.2022, the petitioner had committed sexual intercourse with promise to marry. As on date, the defacto complainant is aged about 21 years.

3. In view of these facts, since investigation is required to be done and the statement of the victim under Section 164 of Cr.P.C. alone had been recorded and no further investigation has been done, at this stage, I am not inclined to grant anticipatory bail to the petitioner. 1/3

4. This is the second Anticipatory bail application. The earlier application had been dismissed on 19.10.2023 in Crl.O.P.No.24020 of 2023. Since, there is no change in circumstances, I am not inclined to grant anticipatory bail to the petitioner.
