THE HONOURABLE MR.JUSTICE BATTU DEVANAND and W.M.P.No. 28713 of 2017 G. Kamarunnisha ... Petitioner Vs.
1.The District Collector, Comibatore District, Coimbatore.
2.The Sub Collector, Pollachi Division, Pollachi.
3.The Tahsildar, Kinathukadavau, Coimbatore District.
... Respondents Writ petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order of the second respondent issued in Na.Kaa.No.2214/2017/A4 dated 06.10.2017 and quash the same.
For Petitioner : No Appearance For Respondents : Mr. L.S.M. Hasan Fizal, Additional Government Pleader 1/4
O R D E R
This Writ Petition has been filed against the order issued in Na.Kaa.No.2214/2017/A2 dated 06.10.2017 wherein the petitioner was transferred from Nallatipalayam Village of Kinathukadavu Taluk to South Village of Valparai Taluk during the pendency of the proceeding issued under the charge memo. In view of the interim order passed by this Court dated 13.10.2017, the petitioner was reposted in the same place.
2.
The learned Government Pleader appearing for the respondents submit that subsequent to the disciplinary enquiry initiated against the petitioner was concluded and a punishment of stoppage of increments for six months without cumulative effect was ordered and thereafter, the petitioner preferred appeal before the appellate authority and the same was also rejected by appellate authority. Consequently, in the routine departmental transfer, the petitioner was transferred again to Somandarkudi Village on 01.07.2022 and she has joined duty on 11.01.2023.
3.
The learned Government Pleader submits that in view of the subsequent development happened after filing the writ petition and during the pendency of the 2/4
writ petition, as the initial transfer order was challenged in this writ petition, no further adjudication is required in the present writ petition. 4.
There is no representation for the petitioner though this writ petition is posted 'for dismissal'.
5.
However, considering the submissions of the learned Government Pleader and in view of the fact that already the petitioner was transferred again in the routine departmental transfer, in my considered opinion nothing survives in this writ petition.
6.
Accordingly, this writ petition is dismissed as infructuous. 7.
Consequently, connected miscellaneous petition is closed. 8.
There shall be no order as to costs.
