Heard the learned counsel for the Appellant and perused the records.

Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 1042 days is condoned, subject to the condition that the appellant deposits a sum of Rs.1,000/- to the credit of the President, Tamil Nadu Advocate's Clerk Association, Madras High Court, Chennai (Indian Bank, High Court Branch, A/c No.484026006, IFSC Code:IDIB000M157), within a period of one week from the date of receipt of the order.

Registry is directed to number the main Civil miscellaneous appeal and list the same for admission. When the matter is posted for admission, the name of learned counsel for respondents 1 and 2 shall also be printed in the cause-list.
