We have heard Mr. U.Karunakaran, learned counsel appearing for the appellants in WA Nos. 273, 274 & 277 of 2023, Mr.J.Lenin learned counsel appearing for the appellant in WA No. 1032 of 2023 and Mr.Richardson Wilson, learned counsel appearing for the contesting private respondents/petitioners in the Writ Petition. 7/11

2. Mr. U. Karunakaran, learned counsel appearing for the appellants would submit that the redoing of the exercise of measuring the height of the candidates as per the directions of this Court dated 02.08.2023 have been completed and a report has also been filed. In view of the said exercise that has been carried out, the Writ Appeals themselves have become infructuous. He would however submit that in view of the report that has been filed, the direction of the learned Single Judge to implead the selectees, who have not been impleaded, may not be very relevant.

Mr. Richardson Wilson, learned counsel appearing for the contesting private respondents/petitioners in the Writ Petition would submit that if there is any change in the select list in future, it would affect those 50 persons who have been directed to be impleaded and therefore, as the petitioners in the Writ Petition they cannot be prevented from taking steps to implead those persons as per the directions of the learned Single Judge.

4. Having considered the submissions, we find that the submission of 8/11

Mr.Karunakaran, learned counsel for the appellants to the effect that the Writ Appeals has become infructuous is just. As regards impleading, we leave it to the wisdom of the learned counsel for the petitioner in the Writ Petitions to either implead or not to implead, those persons who have been directed to be impleaded.

5. The Writ Appeals are disposed of as infructuous. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
