The petitioner seeks bail in Crime No.24 of 2021, registered by the respondent police for the offences punishable under Sections 5(1), (j)(ii) and 6 of POCSO Act. The petitioner had been remanded to custody on 25.10.2023.

2.It is stated that on 20.09.2021, an unknown person had blindfolded the minor daughter of the defacto complainant and engaged in sexual intercourse. It was thereafter found that the minor child was two months pregnant. A complaint had been lodged on 26.11.2021. The fetus had been aborted. Thereafter, the victim child had identified the petitioner as the person responsible.

3.It is stated that tissue samples had been taken and the same had been forwarded for DNA analysis. That report is still awaited. This would only indicate that that investigation has not yet been completed. https://www.mhc.tn.gov.in/judis
