ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 316(4), 344, 61(2) of BNS Act 2023, in Crime No.466 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is running a Pawn Broker shop in the name and style of Sri Krishna Pawn Brokers and the petitioner along with other persons in the above said shop, have misappropriated and swindled 853 grams of gold ornaments. Hence, the complainant.

4. The learned counsel for the petitioner submits that the petitioner is an innocent person and she was falsely implicated in this case. Hence, he prayed for anticipatory bail to the petitioner.

5. The learned counsel for the Intervenor raised strong objection for granting anticipatory bail to the petitioner and stated that the petitioner swindled 853 grams of gold ornaments from the defacto complainant.

6.The Government Advocate (Criminal Side) submits that the investigation is not yet over and if the petitioner is released on bail, he will abscond.

6. Considering the facts and circumstances of the case and the nature of allegation against the petitioner, and the fact that the investigation is in preliminary stage. I am of the opinion that if the petitioner is enlarged on bail he may abscond. Hence, this Court is not inclined to entertain this petition.
