This Writ Petition has been filed challenging the refusal check slip dated 28.08.2019 issued by the respondent thereby the registration of the sale deed produced by the petitioner was refused.

2. Heard the learned Government Advocate appearing on behalf of the respondent and perused the materials available on record.

On perusal of the records, it is revealed that the petitioner claims to be the owner of the property comprised in Survey Nos.300/5 and 300/6 measuring to an extent of 3.14 acres situated at Palambadi hamlet of Sengunam Village. According to the petitioner, the said property was purchased by him from one Sengan, represented by his General Power Agent, Kannan. Thereafter, the said Kannan attempted to take possession of the subject property and as such the petitioner was constrained to file a suit in OS.No.316/2013, on the file of the District Munsif Court, Peramballur. The said suit was decreed in favour of the petitioner without contest, as the said Kannan raised no objection to the plaint and submitted to the passing of the decree. However, the suit was decreed only against one Kannan and not against the original owner of the property by name Sengan. That apart, at the time of registration before the respondent, the petitioner produced an unregistered sale deed. 2/4

4. Therefore, the sale deed was rightly rejected for registration by the respondent and this Court finds no infirmity or illegality in the refusal check slip issued by the respondent dated 28.08.2019.
