ORDER
By placing reliance on G.O.(2D).No.375, Home (Police-1A) Department, dated 20.11.2025 and G.O.(2D). No.382, Home (Police-1A) Department, dated 25.11.2025, the learned Additional Advocate General claims that all the benefits, including the promotional benefits, namely, Additional Superintendent of Police and Superintendent of Police, have been sanctioned to the petitioner, and his seniority was also notionally fixed above his immediate junior.
2. Insofar as the monetary benefits are concerned, the learned Additional Advocate General places reliance on the Admissibility Report of the Accountant General dated 10.12.2025. At this juncture, the learned counsel appearing for the petitioner would raise an objection stating that insofar as the promotion to the post of Superintendent of Police is concerned, the seniority in the promotional list has not been properly fixed above the name of one Mr.M.Chandrasekaran, who is the petitioner's immediate junior.
3. The learned Additional Advocate General, however, would object to the said contention by stating that M.Chandrasekaran's candidature was considered from the accelerated seniority list and that promotion granted to him was subsequently cancelled.
4. In my view, these disputed facts cannot be adjudicated in the contempt petition. However, since the Government passed two orders granting notional promotion to both the posts and the monetary benefits have also been admitted by the Accountant General, the disobedience alleged cannot be termed to be wilful in nature.
5. Accordingly, this Contempt Petition stands closed.
