PRAYER : Transfer Civil Miscellaneous Petition filed under 24 of Code of Civil Procedure, pleased to withdraw the H.M.O.P.No.605 of 2022 pending on the file of the Family Court, Tiruchirapalli and transfer the same to the Family Court, Chennai.

ORDER

The respondent wife in H.M.O.P.No.605 of 2022 pending on the file of the Family Court, Tiruchirapalli, is the petitioner herein has filed this Transfer Petition seeking to transfer the aforesaid H.M.O.P to the file of the Family Court, Chennai.

2.The reasons for the transfer has set out and argued on behalf of the petitioner is that:- a)petitioner and her minor son are both living at Sholinganallur, Chennai.

b)petitioner is working at Perungudi, Chennai and she does not have any support.

c)the matter is pending before Family Court, Tiruchirappalli and therefore petitioner has to be present for every hearing and the distance between Sholinganallur and Tiruchirapalli is over 316 kms and it is a 5 hours and 20 minutes travel.

3.Though respondent has been served, there is no representation for the respondent.

4.Heard the learned counsel for the petitioner and perused the records.

5.Considering the above reasons which are justifiable, the request of the petitioner can be granted. Therefore, this Transfer Civil 2/4

Miscellaneous Petition is allowed and H.M.O.P.No.605 of 2022 is withdrawn from the file of the Family Court, Tiruchirappalli, and transferred to the file of the Family Court, Chennai. No costs.
