ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.08.2025 for the alleged offence under Section 24(1) of the COTPA Act and Section 123 of BNS, in Crime No.133 of 2025, on the file of respondent police, seeks bail.

2. The case of the prosecution is that, the petitioner was in illegal possession of 342.5 kgs of tobacco products in his vehicle, without a proper licence. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that the petitioner has been suffering incarceration from 13.08.2025. He also submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that the petitioner was in illegal possession of 342.5 kgs of tobacco products, without a proper licence and that he has 10 previous cases, pending against him. Hence, he vehemently opposed the grant of bail to the petitioner.

5. Taking note to the gravity of offence, and on considering the bad antecedents, this court is not inclined to grant bail to the petitioner.
