(Order of the Court was made by the Hon'ble Chief Justice) Heard Mr.M.Dhandapani, learned counsel for the applicant, Mr.K.Karthik Jagannath, learned Government Advocate for respondents 1 to 4 and Mr.N.Sivavarthanan, learned counsel for respondent 5.
2. The present application is filed for withdrawal of the amount of Rs.50,000/- (Rupees Fifty Thousand Only), deposited by the applicant pursuant to the order of this Court for entertaining the writ petition.
3. The writ petition was disposed of by this Court under order dated 17.10.2023, however, the order with regard to refund is not passed. The amount was directed to be deposited to test the
bonafides of the applicant. This Court has disposed of the writ petition, directing the authorities to proceed ahead pursuant to the order under Section 6 of the Tami Nadu Land Encroachment Act, 1905. In view of that, there were no malafides.
4. Learned counsel for the applicant, on instructions of the applicant, submits that the applicant is ready to donate an amount of Rs.10,000/- (Rupees Ten Thousand Only) to the Tamil Nadu State Legal Services Authority.
5. We appreciate the gracious stand of the applicant. Registry shall remit the amount of Rs.10,000/- (Rupees Ten Thousand Only) to the Tamil Nadu State Legal Services Authority and allow the applicant to withdraw Rs.40,000/- (Rupees Forty Thousand Only). (S.V.G., CJ.) (D.B.C.,J.) 24.11.2023 drm
