ORDER

This Criminal Original Petition has been filed to set aside the order dated 02.08.2025 passed in Crl.M.P.No.2 of 2025 in C.A.No.1083 of 2024 by the learned XVIII Additional Judge, XVIII Additional City Civil Court, Chennai and seeking extension of time to deposit 20% of the cheque amount.

2. The petitioners are the accused in C.C.No.2324 of 2019 on the file of the III Metropolitan Magistrate, George Town, Chennai. They were convicted for the offence under Section 138 of the Negotiable Instruments Act. Aggrieved by the conviction order passed by the trial Court, the petitioners herein filed an appeal in C.A.No.1083 of 2024 along with Crl.M.P.No.36660 of 2024 before the Principal Sessions Court, Chennai seeking suspension of sentence pending disposal of the appeal. The learned Principal Sessions Judge granted bail subject to condition that the petitioners have to deposit 20% of the compensation amount before the Trial Court.

The grievance of the petitioner is that though the appellate Court granted extension of time to deposit 20% of the compensation amount vide order dated 02.08.2025 in Crl.M.P.No.2 of 2025 in C.A.No.1083 of 2024, due to freezing of bank account pursuant to proceedings in another case, they could not comply the same within the stipulated time. Hence, the petitioners seek further extension of time to comply the conditional order passed in Crl.M.P.No.2 of 2025 in C.A.No.1083 of 2024.

4. Considering the submissions made by the learned counsel for the petitioner and considering the nature of dispute, this Court is granting three weeks time from today ( ie., from 12.09.2025), to comply the conditional order dated 02.08.2025 passed in Crl.M.P.No.2 of 2025 in C.A.No.1083 of 2024.

5. With the abovesaid direction, this criminal original petition is disposed of.
