The petitioner seeks bail. He is an accused in PRC No.27 of 2023 pending trial before the learned Judicial Magistrate - II, Tindivanam. Originally, Crime No.327 of 2023 had been registered under Section 392 IPC and later altered to Section 395 IPC. The petitioner had been taken into custody on 19.08.2023. 2.It is the case of the prosecution that on 05.07.2023, when the defacto complainant was traveling in a two wheeler, two known persons in a Pulsar bike chased her and snatched the gold chain. She lodged a complaint. It was found that a car was also following the said two wheeler and overseeing the operation. The petitioner was in the car. It is stated that this incident happened in the highways. It was also deducted that same offence had been committed earlier, which was registered in Crime No.306 of 2023.

3.It is the specific case of the respondent that a similar incident had happened in Karur and at that time, the car was seized and photographs were circulated and then it was found about the involvement of this petitioner in this crime number. It is also stated that the respondent had matched the telephone calls and the investigation revealed that it is the same modus operandi of the same accused, who are involved in both offences.
4.The learned counsel for the petitioner however, stated that the other accused had been granted bail by the Principal Sessions Judge, Villupuram. But unfortunately, it is not known whether the Assistant Public Prosecutor, who appeared before the said Court had appraised all the facts before the learned Principal Sessions Judge and the fact that the same modus operandi had been used again and again and also at Karur in a separate district.
5.The respondent will have to continue with their investigation to find out whether this modus operandi had been used and adopted in 2/4
any other crime number in the highways in any other district. 6.Even though the other accused had been granted bail, taking into consideration the seriousness of the offence, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
