The petitioner is an accused in Spl.S.C.No.234 of 2019, now pending before the XX Additional Sessions Judge at Chennai. Originally, Crime No.9 of 2018 had been registered by the respondent police for the offences punishable under Sections 147, 148, 450, 307 r/w 149 of IPC, seeks bail.

2.The petitioner had been granted bail but for reasons best known to him, he absconded appearing before the Court on 24.04.2023. 3.The learned counsel for the petitioner states that the mother of the petitioner died but the petitioner should have surrendered before the Court or filed an application to seek recall of the Non-Bailable warrant. The respondent had to secure the petitioner on 18.07.2023 and because of this, all the other accused also suffered, as the trial had only been delayed.

4.It is also stated that there 18 previous cases against the petitioner herein. Even though that factor would have been considered while granting bail to the petitioner, it is a significant factor to hold that there is possibility of the petitioner once again absconding. 5.Let the injured/defacto complainant be examined and crossexamined and after that, fresh application for bail can be considered.

6. In view of that particular fact, I am not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original Petition stands dismissed.
