This petition has been filed seeking to condone the delay of 204 days in filing the above Second Appeal.

2. The learned counsel for the petitioner submits that the appeal was dismissed during the Covid Pandemic, due to which, they are not able to get the copy and file the appeal in time. Hence, he prayed to condone the delay in filing the appeal.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition with the condition that the petitioner shall a pay a cost of Rs.2,000/- to the respondent counsel within a period of one week from the date of receipt of a copy of this order. Registry is directed to number the Second Appeal if it is otherwise found to be in order and post the matter on 27.11.2024.
