ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Issuance of summons is under challenge in this petition on the ground that petitioner is not involved in Crime No.4 of 2021 on the file of CBCID, Kancheepuram.
2. According to petitioner, offence was registered against one Ashish Mehta, Shanmugam and Radhakrishnan under Sections 120B, 465, 468, 471, 477A and 420, IPC for alleged fraudulent transfer
of patta in respect of lands in S.No.310/1 in Beemanthangal Village, wherein, it is alleged that he received Rs.33 crore in respect of compensation towards acquisition of land for Bangalore National Highway.
3. Counter has been filed by second respondent.
4. Learned counsel for petitioner prays for adjournment. We are not inclined to grant adjournment, taking into consideration that presently, only summons have been issued against petitioner. In the absence of there being any illegality with reference to provisions of law in the matter of issuance of summons to petitioner, no interference is called for.
5. We are not expressing any opinion on the merits of the case. The issuance of summons to petitioner is only for the purpose of seeking appropriate information from petitioner.
6. Therefore, no case is made out. Petition is dismissed. There
shall be no order as to costs. Consequently, the interim application are also dismissed.
