The petitioner who is the accused for offence under sections 279 and 304(A) IPC was convicted by the trial court and confirmed by the lower appellate court, against which he filed the revision and the suspension of sentence.

2. This court while suspending the sentence on 28.07.2022 imposed some conditions, out of which, one of the conditions is that the petitioner has to appear before the respondent police daily at 10.30 am.

3. The contention of the petitioner is that the petitioner is a native of Thenkasi and the petitioner has to appear before the respondent police i.e., at Coimbatore. The accident took place in the year 2015. The petitioner is settled in Thenkasi along with his family and he is staying at Thenkasi. Since he has no relatives, friends or anybody in Coimbatore, he is finding great difficulty, to the travel between Thenkasi and Coimbatore. During the recent days, his father passed away and due to the said condition, he could Page 1/4

not attend the entire ceremony. He also submits that the petitioner is complying with the order of this Court.

4. Learned Additional Public Prosecutor would submit that the petitioner is regularly appearing before the respondent police and thereby complying with the order of this Court.

5. Considering the submissions made on either side, the condition that the petitioner has to appear before the respondent police daily at 10.30 a.m. is relaxed.
