This application has been filed seeking leave to sue the above suit before this Court.

2. It is the contention of the learned counsel for the plaintiffs that infringed products have been sold within the jurisdiction of this Court. That apart, the defendants themselves have filed an application before this Court for revoking the patent granted to the plaintiffs, which was ultimately dismissed by the Division Bench. Hence, it is the contention that since the infringed products are available within the jurisdiction of this Court, the cause of action arose within the jurisdiction of this Court and as such, this Court has jurisdiction to entertain the suit having regard to the allegations particularly, the orders of the Division Bench, wherein, a dispute has been already raised by the defendants with regard to the products and the cause of action arose within the jurisdiction of this Court. Hence, Leave granted. Accordingly, this Application is allowed. The Registry is directed to number the suit and post the same on 29.11.2019.
