A6 and A7 have filed Crl.O.P.No.27182 of 2023 and A5 and A8 have filed Crl.O.P.No.27184 of 2023, both in Crime No.896 of 2023, registered by the respondent police for the offences punishable under Sections 341, 147, 148, 302 (2 counts) & 120(B) of IPC.

2.The earlier application seeking bail of the accused had come up for consideration on 06.11.2023 and the same had been dismissed by this Court. 3.It is stated that there are totally nine accused and one of the accused is a juvenile and therefore, in Crime No.896 of 2023 there are eight accused. Four of the accused have sought bail. They have been in judicial custody from 02.09.2023 and 03.09.2023 alternatively.

4.The learned Government Advocate (Crl. Side) for the respondent stated that now charge sheet had been filed before the Judicial Magistrate III, Ponneri. That is a change in circumstance, which is insisted upon by the learned counsel 1/4

for the petitioner herein but one further fact which has to be noted is that one of the deceased was actually injured and later, after being admitted to hospital, had died. He had given statements to his parents which had been reduced in writing and he mentioned the presence of all these petitioners at the scene of occurrence. 5.Though final report had been filed, let the case be committed to the Court of Sessions and at that stage, the Sessions Court can take control all the accused and impose necessary conditions. At this stage, I am not inclined to grant bail to the petitioners in both Crl.O.Ps. Accordingly, these Criminal Original Petitions stand dismissed.
