ORDER

The present application has been instituted seeking extension of the lease of the land in S.No.160/3 Malayaperumal Agaram, Cuddalore District in M.P.Agaram 2.75 Acres belonging to the Diwan Bahadur A.Subbarayalu Reddiar Trust under the control and management of the Administrator General

of TamilNadu.

2. Admittedly, the lease expired on 30.06.2023. The learned Administrator General of Tamilnadu would submit that the lease was not further extended nor any agreement was entered into with the applicant. The Advocate Commissioner appointed to conduct inspection of the land would submit that the total extent of 30 acres belongs to Administrator General of Tamilnadu. The lands are leased out to various other persons and rents are being collected. Further, the encroachments identified were also evicted. Thus, the Administrator General has to conduct site inspection, mark the extent of the lands by metes and bounds and ensure that no further encroachments are allowed and the property belongs to the Trust is protected and leased out to fulfil the wishes of the executor.

3. As far as the applicant herein is concerned, the property measuring an extent of 2.75 acres was leased out and the lease expired on 30.06.2023.

4. Learned counsel for the applicant would submit that the applicant was paying the rent punctually without committing any default.

5. That being the case, the learned Administrator General of Tamilnadu, after conduct of inspection of the property and by ascertaining the market lease rent in that locality and thereafter, enter into an agreement by fixing the

market lease rent along with the usual conditions. In respect of the period during which the lease was not in force, any additional rent to be collected also may be recovered from the applicant.

It is made clear that the Administrator General of Tamilnadu shall initiate all actions to ensure that the Trust properties are protected and no encroachments are allowed and in this regard, they may utilise the services of the local police, revenue authorities and Village Administrative Officer and other Department officials, if required.

In respect of the claim of the applicant for allotting additional extent of land, the learned Administrator General of Tamilnadu would submit that the remaining lands have already been leased out to other persons. Therefore, there is no possibility of allotting additional lands to the applicant herein.
